Terms of Use

These terms apply when you use doxagraf.com, use a client portal account, or book or buy services from Doxagraf. Please read them before you book. Your quote, proposal or invoice may add terms for your project. If the two conflict, the project document applies.

Who we are and your agreement

doxagraf.com is run by Doxagraf LLC, a New Jersey limited liability company. By using the site or booking a service, you agree to these Terms and to our Privacy Policy. If you book for a brokerage, team or company, you confirm that you are allowed to accept these Terms for it.

Using our website

You are welcome to browse the site, share links to it and contact us through it. Please don't:

Copy, download or reuse photos, video or designs from the site.
Scrape the site or use automated tools to collect its content.
Try to break, overload or get around the site's security.
Use the site for anything illegal or misleading.

Our content

The photos, video, designs, text and logos on this site belong to Doxagraf or to our clients and are protected by copyright and trademark law. Showing work here does not give anyone the right to use it. To ask about licensing an image, email info@doxagraf.com.

Client portal accounts

We create portal accounts for clients to review drafts, give feedback and approve work. Keep your login private. You are responsible for activity in your account, and an approval given through your account counts as your approval. Tell us right away if you think someone else has used it. We may suspend an account that is misused.

Booking and scheduling

Real estate shoots are booked through our real estate booking page. Calls and other projects are booked through our site or by quote.
When you book a shoot, you confirm that you have the owner's or occupant's permission for us to enter, photograph and film the property, including from the air.
Please have the property ready at the booked time: lights working, rooms tidied and personal items put away. If the property isn't ready or we can't get in, we may need to reschedule.
Exterior and drone shots depend on weather, daylight and airspace rules. We may move them to a better day at no extra charge, and we may decline a drone flight when conditions or regulations don't allow it safely.
There is no fee to reschedule or cancel unless one is stated in your quote, proposal or booking confirmation. Please let us know as early as you can.

Quotes, payment and refunds

Quotes and proposals are valid for 15 days unless they say otherwise.
Payment is due before a shoot or project starts. Depending on the project, that is either a 50% deposit or the full invoice, as shown on your invoice. We schedule the work once payment is received.
When you pay a 50% deposit, the remaining balance is due before the final work is delivered.
Retainers and monthly plans renew as described in your agreement or pricing plan.
Printing, rush delivery, travel outside our service area, extra edits and other add-ons are quoted separately.
Invoices more than 30 days past due may pause work and portal access.
All payments are final. We do not offer refunds. Before you book, please ask us any questions, look through our work, request examples and read our FAQ page. If something isn't right the first time, we will work with you and redo it so you get what you're looking for.

Delivery

We deliver photos and video through online galleries, and designs through the client portal or by email. Delivery times given at booking are estimates and can change with weather, project size, revisions and response times. Delivery galleries stay available for up to six months after delivery and your approval, so please download your files during that time. After that, Doxagraf may keep copies of the work in our internal archive, at our discretion, for our portfolio and case studies.

Revisions and approvals

Photo and video: we edit color, light and composition in our studio style. Every delivery includes at least one round of revisions. Ask for fixes within 5 days of delivery at no charge. Advanced edits, such as virtual staging or major object removal, are quoted separately.
Headshots: you choose from proofs, we retouch the photos you approve and deliver them as finals. The number of final images is set by your package.
Design and print: every project includes at least one round of revisions. The number of rounds for your project is set in your quote or proposal. Extra rounds and changes after approval are billed separately.
Proofs: please check every proof carefully, including names, phone numbers, license numbers, prices and spelling. Once you approve a proof for print or publishing, reprints or corrections caused by errors in that proof are billed to you. Printed colors can vary slightly from what you see on screen.

Who owns the work and how you can use it

Real estate photos, video, 3D tours and floor plans

Doxagraf keeps the copyright. Once paid, the agent, team or brokerage that hired us receives a non-exclusive license to use the media to market that property: on the MLS, Zillow and other listing sites, brokerage and agent websites, social media, ads, signs and print. Any other use, such as after the listing ends, follows what was agreed when you ordered.

This license can't be transferred. Other agents, sellers, buyers, builders, stagers, architects, designers and publications need their own license from us. Please don't resell the media or present it as someone else's work.

Headshots and team photos

Doxagraf keeps the copyright. Once paid, you may use your final photos for your personal and professional branding, including websites, social media, signs, print and ads, for as long as you like. A team or brokerage may use photos of its members while they are part of the team. Please don't sell the photos or license them to others.

Logos, branding, design and social content

Once paid in full, you own the final approved logo, brand and design files we deliver, and we transfer our copyright in those final files to you. Drafts, unused concepts and any other assets developed during the process, along with our templates and working files, always stay with Doxagraf. Licensed fonts and stock images follow their own license terms.

Our portfolio

We may show work we create for you on our website, in our portfolio, on social media and in our marketing, and we may name you as the client. If you need a project kept private, tell us in writing before it starts. Homeowners can ask us to remove their property from our portfolio at any time.

Your materials

You confirm that you have the rights to the logos, photos, text and other materials you send us, and you allow us to use them to complete your project.

Other platforms

Our work often ends up on platforms we don't control, such as Zillow, the MLS, Instagram, TikTok and print vendors. Each has its own rules, file limits and compression, and may change how content looks or remove it. We are not responsible for their decisions or downtime.

Disclaimers

We work to keep the site accurate and available, but it is provided "as is," and we can't promise it will always be available or free of errors. Results we show from past projects, such as views, inquiries or how fast a home sold, are not a guarantee of results for your project.

Limits on liability

To the fullest extent allowed by New Jersey law, Doxagraf's total responsibility for any claim related to a service is limited to the amount you paid us for that service. We are not responsible for indirect losses, such as lost commissions, lost profits or a delayed sale. Nothing in these Terms limits responsibility that New Jersey law does not allow us to limit.

Your responsibility

If someone makes a claim against Doxagraf because of materials you gave us, your use of our work beyond your license, or a property you told us we could shoot without the right permission, you agree to cover our reasonable costs from that claim, including legal fees.

Governing law and disputes

These Terms are governed by the laws of the State of New Jersey. If a problem comes up, we both agree to try to resolve it by talking first. If that doesn't work, any dispute will be handled in the state or federal courts for Bergen County, New Jersey.

Changes to these Terms

We may update these Terms from time to time. The version posted here, with the date at the top, applies to new bookings from that date. Projects already underway keep the terms they started with.
